1. Introduction

These Terms and Conditions apply to the use of the PupandTote website and to the purchase of products offered through it. PupandTote is a store operated by Nova Spark Group (“we”, “us”, “our”). By using our website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy.

2. Acceptance

By placing an order you confirm that you are at least 18 years old, that you are able to enter into a legally binding contract, and that the information you provide is true and accurate. If you do not agree to these Terms, please do not use the website or place an order.

3. Personal use

You agree to purchase products for your own personal, non-commercial use and not for resale.

4. Prices

Prices shown on our website are in the currency displayed at checkout and include shipping. We do our best to ensure all descriptions and prices are correct, but errors may occasionally occur. If we discover a pricing error affecting your order, we will contact you so you can confirm the correct price or cancel for a full refund. Prices may change from time to time, but changes will not affect an order we have already confirmed.

5. Placing an order

All orders are subject to availability. After you order, you will receive an order confirmation, which confirms we have received your order. A contract is formed only once we issue that confirmation. If your order contains several items, they may be delivered together or separately. We reserve the right to refuse or cancel an order; if we cancel after payment, you will receive a full refund.

6. Payment

You can pay using any of the payment methods shown at checkout (including Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay and PayPal). You confirm that the payment method used is yours and that you have sufficient funds. Payments are handled by secure third-party payment providers; we are not a payment processor and are not responsible for failures caused by those providers.

7. Handmade & made-to-order items

Many of our products are handmade to order, and personalised items (such as bags made from a photo you upload) are created individually for you. As each piece is handmade, slight natural variations may occur and are not considered defects. Product images are for illustration and the item you receive may vary slightly.

8. Delivery

We will deliver to the address you provide at checkout and offer free shipping on all orders. Estimated dispatch and delivery times are set out in our Shipping Policy. We are not liable for delays outside our reasonable control, but we will always keep you informed and help resolve any problem.

9. Cancellation and returns

You may cancel within 24 hours of ordering, and you may return eligible items within 30 days of delivery, as described in our Refund Policy, which forms part of these Terms.

10. Faulty products

If a product arrives faulty, damaged or incorrect, contact us with a photo and your order number and we will, at our discretion, replace the item or issue a refund, including any related delivery cost.

11. Acceptable use

You must not misuse our website, including by introducing malicious software, attempting to gain unauthorised access, scraping data by automated means, infringing our intellectual property, or placing false or fraudulent orders. We may suspend or refuse access to anyone who breaches these Terms.

12. Intellectual property

All content on this website, including designs, images, text and branding, is owned by or licensed to Nova Spark Group and is protected by law. You may use the website only for your own personal, non-commercial use and may not copy or reuse our content or trademarks without our written consent.

13. Liability

To the fullest extent permitted by law, we are not liable for indirect, special or consequential loss, and our total liability arising from any order is limited to the price you paid for the products giving rise to the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

14. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time of your order applies to that order.

15. Governing law

Nova Spark Group operates from the Netherlands. These Terms are governed by the applicable laws of the Netherlands and the European Union, without affecting any mandatory consumer rights you have in your country of residence.
